If you have no court case for insurrection, then you have no way of demonstrating there even was an insurrection - much less that any particular individual took part in it or incited it. You can't invoke articles of the constitution against someone when you have nothing to base it on, but partisan feelings of pure animus. It amounts to randomly slinging someone off the ballot - against the wishes of 50% of the electorate.

If the required evidentiary standard of the event itself - and participation in it - is zero, presumably we can sling everyone off the ballot for inciting an insurrection - using precisely the same article
